Terms & Conditions
FULL TERMS AND CONDITIONS
- The competition is open to residents of the UK aged 18 or over only, excluding employees and immediate families of the Promoter, their agents and anyone else professionally and directly connected with the running and marketing of the competition and the provision of the prize.
- Entrants may enter the competition by themselves by submitting an entry, or two entrants may submit one joint entry (the "Entrant(s)" or "you"). The prize (described below at paragraph 9) will be the same regardless of how entries are made, and equal consideration will be given to single and joint entries.
- To enter the competition, you will need to visit www.facebook.com/marsbar (the "Competition Site") and do the following:
- Enter your details into the online form provided at the "Mars Competition" tab (to include your full name, address, post code, town/city, a valid email address and daytime contact telephone number). Where you and a friend are making a joint entry, you should ensure that the other joint entrant has given their permission to the entry, tick the appropriate box on the entry form confirming this and provide the full name of the other joint entrant.
- In one or a combination of the methods set out below, explain to the Promoter in the most creative, compelling and passionate way what the England "3 lions" crest and the England football team mean to you - this can be based on and/or include personal experiences - (a "Submission"). Where two Entrants are making a joint entry, the materials used in the Submission should refer to and, where an image or video are uploaded, include images of both Entrants. Submissions can be made in one or a combination of the following ways:
- a 180 word description;
- an image (.jpg or .png file only and not to exceed 5Mb limit); and/or
- video (.mpg, .avi, .wmv or mp4 file only and not to exceed 5Mb limit).
- Where two Entrants are making a joint submission, if the appropriate boxes included on the entry page are not ticked confirming that the additional entrant has given their permission to be entered into the competition and have their name and image used as part of a Submission, that entry will be rejected.
- Only one entry per person. A joint entry will count as an entry by each of the two entrants for these purposes.
- Entries to be received online between 15:00 on Saturday 20 February 2010 and 23:59 on Sunday 18 April 2010.
- The winner will be selected on Monday 19 April 2010. The winner will be the Entrant who, in the opinion of our panel of judges, has entered the best Submission. The judges will comprise experts from a promotional creative agency and representatives of the Promoter and The Football Association Limited ("The FA"). The panel's decision is final and binding in all matters and no correspondence will be entered into other than with the winner.
- The winner will be notified by telephone on Monday 19 April 2010 and will be asked to confirm their details (and in the case of a joint entry, the other entrant's details). A winner who has submitted incorrect personal details when submitting their entry risks forfeiting their prize.
- There is one prize of a two day, one night trip, to Austria for two people. Where a joint entry has been made, the joint Entrants must both go on the trip. Where the winner is a single entrant, they may take a guest of their choice on the trip. The prize consists of 2 tickets (each ticket to guarantee one entry only) to see the England men's senior football team train in Austria, return transfers to the training ground/hotel, 2 x return economy flights from London Heathrow airport to Vienna airport, transfers to and from the hotel and Vienna airport, 1 night stay in a 4* hotel in Vienna, Austria, based on 2 x single rooms and on a bed and breakfast basis, £100 spending money per person and travel insurance.
- Entrants must be available to travel between 17-23 May 2010 (inclusive) due to the training timetable of the England team. The Promoter will inform the winner of the exact date of the trip. Where a joint entry has been made and one of those Entrants is unable to travel between these dates, the Entrant who is able to travel is entitled to take one guest of their choice on the trip who is 18 or over.
- In the event that the winner refuses acceptance of the prize or, for whatever reason, cannot make the trip during the relevant periods, or the Promoter is unable to make contact with the winner within 7 days following the notification date, the Promoter reserves the right to award the prize to an alternative winner.
- The winner (and travelling guest) are liable for their own travel expenses to and from the UK airport (London Heathrow) and for all other meals/drinks and any other costs not included in the above prize package. It is the winner’s responsibility to ensure that their (and their guest's) passports are up to date and valid for the duration of the trip and that they have any necessary visas or similar for the trip. In the event that the winning entry has been submitted by a single individual, the winner's travelling guest must be aged over 18 also.
- The prize is as stated, is non-transferable and no cash alternative is available. The Promoter reserves the right to award an alternative prize of equal or greater value, should the advertised prize or any part of it become unavailable for any reason. A winners is strictly prohibited from selling their prizes to any other person.
- By entering your Submission into the competition, you confirm that your Submission (including any written descriptions, images and/or videos) is your own sole and original work (or, in the case of a joint Submission, the joint, original work of the two Entrants) and you have not copied your Submission from anyone else, or used anyone else's materials to create your Submission. You also confirm that you have obtained the permission of any person featured in any part of your Submission (including an image or video) to submit their image, name, likeness, performance, appearance and/or personal experience as part of this competition. In addition, you hereby grant to the Promoter all consents, and confirm that you have obtained the all consents from any person featured in your Submission, which may be required for the exploitation of your Submission by the Promoter or any third party authorised by the Promoter, including, without limitation, consent for the Promoter and any third party authorised by the Promoter to use your image, name, likeness, performance, appearance and personal experience(s) and that of any other person featured in your Submission, in connection with your Submission. You hereby waive your moral rights throughout the world to the fullest extent permissible by law.
- By entering your Submission into the competition, you warrant and confirm that your Submission (including any and all parts of your Submission) is not obscene, defamatory, blasphemous, offensive or untruthful; does not promote or incite racial or religious hatred or any other form of hatred, violence, aggression or discrimination; does not and is not likely to infringe any copyright, right of privacy, right of publicity, moral right or any other right whatsoever of any third party; is not derogatory or damaging to the goodwill and/or reputation of the Promoter, Mars or any Mars products or The FA or the England football team; does not feature or otherwise promote tobacco, alcohol or drugs or any commercial products or services of any third party other Mars bar products and the England football team; and does not otherwise breach and is not likely to cause the Promoter or The FA to breach, any UK laws. The Promoter retains the right (but not the obligation) to disqualify any entries which the Promoter considers, in its sole discretion, to contain any material that breaches the requirements of this Condition 15 and/or any entries which the Promoter considers, in its sole discretion, to be likely to cause undue distress or upset to any person.
- You agree that the Promoter can use, and can authorise any third parties to use, any part of your Submission without restriction in any media throughout the world and for any purpose whatsoever (including, without limitation, to publicise the winner, to advertise the competition and for future promotions of the Promoter, advertising and marketing campaigns). The Promoter has the right to adapt your Submission (including editing, deleting, copying etc) and to transfer your Submission to different media formats. For example, the Promoter may decide to use footage stills of you on the Promoter's website or to use your written description in a Promoter advertisement. Where your Submission is not the winning entry in the competition the Promoter, if it wishes to, shall be entitled to make any independent commercial use of your Submission that is outside the scope of this competition in an advertising or marketing campaign, in which event you agree to provide the Promoter with all the necessary waivers and consents that are necessary for such exploitation, subject to agreement as to any commercial terms of such use.
- If you are selected as the winner, you will, at the Promoter's request, assign your rights in the Submission to the Promoter. You shall also provide the Promoter with all necessary consents and waivers in relation to the Submission to the fullest extent possible. Failure to provide the Promoter with the relevant assignments, consents or waivers will disqualify you from the competition and a new winner will be selected.
- You may use the Promoter's trade marks relating to the Mars brand (together with, for the avoidance of doubt, Mars bar products) and the England "3 lions" crest in your Submission solely for the purposes of entering this competition but for no other purpose whatsoever. For the avoidance of doubt, entering this competition does not give you any other right to use any intellectual property rights owned or used by Mars or The FA, including, without limitation, any Mars or FA trade marks or extracts from the Competition Site.
- By entering the competition you agree that the Promoter may use and store your personal details in the course of running the competition as set out in these terms and conditions, for related purposes such as promoting the competition and announcing and publicising the winner and advertising the Promoter's products, subject to compliance with applicable data protection laws.
- Proof of submitting your entry is not proof of receipt of any entry by the Promoter. The Promoter is not responsible for any entries that fail to be submitted for any technical reason whatsoever. Entries submitted by any other means (including by post) will be rejected.
- The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this competition in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any Entrants or third parties.
- The Promoter cannot be held responsible for the failure of any third parties to fulfil their obligations associated with this competition. The winner and their travelling guest will be bound by any terms imposed by any third parties providing services as part of the prize. The winner and their travelling guest must comply with the conditions of entry applicable at the training ground in Austria. In the event that the winner and/or guest are rude, abusive or otherwise unsuitable, they may be required to leave the training ground immediately.
- By entering this competition, all Entrants will be deemed to have accepted and be bound by these terms and conditions, together with the user terms of Facebook (available at http://www.facebook.com/terms.php?ref=pf). All entry instructions form part of the terms and conditions. Any breach of these terms and conditions or the user terms of Facebook by the winner may result in forfeiture of their prize.
- By entering the competition, you agree that the Promoter may contact you in the future for marketing purposes, even if you are not selected as a winner. The winner and their guest (where applicable) will be required to participate in related publicity, including participation in a report (in any media chosen by the Promoter) of the trip, which will be used by the Promoter for promotional purposes.
- Neither the Promoter, Mars, nor The FA (including The FA's group companies, officers, employees, agents and advisors) shall have any liability to any Entrant, the winner or their guest in connection with this competition, any Submission or the prize, save as required by law or as specifically set out herein.
- The winner's details (name and county) will be available after 27th April 2010 for a period of six weeks by sending a stamped self-addressed envelope to Mars Austria Training Session Facebook Competition Winners List, Octagon, Octagon House, 81-83 Fulham High Street, London SW6 3JW.
- This competition and these terms and condition are governed by English law and subject to the exclusive jurisdiction of the English Courts.
The term "Promoter" as used in these terms and conditions means Mars Chocolate UK Limited, 3D Dundee Road, Slough, Berkshire, SL1 4LG.
The term “Mars” as used in these terms and conditions means Mars Chocolate UK Limited and any subsidiary undertaking and/or parent undertaking of Mars Chocolate UK Limited and/or any subsidiary undertaking of any parent undertaking of Mars Chocolate UK Limited (as such terms are defined in the Companies Act 2006).
